FORT LAUDERDALE, Fla. (WSVN) — A jury has began deliberating to decide the fate of a former Hollywood Police officer accused of a cover-up.

On Tuesday, the two women and four men jury must decide if 45-year-old Dewey Pressley is guilty of his role in an attempt to cover up a crash involving a police cruiser during a DUI stop, back on Feb. 16, 2009.

Though he refused to testify in his own defense in court, his actions were caught on police equipment at the scene.

Alexandra Torrensvillas was intoxicated, but ultimately had her case thrown out after Pressley was accused of using her state as an excuse to pin the blame of a police cruiser’s crash into the rear of her vehicle. A police dashcam video, which also recorded audio, was used by prosecutor Tim Donnelly at the trial. “Without these 12 minutes on this videotape, these dirty dozen minutes, we would think that this is a normal DUI,” he said, “that nothing is out of the ordinary here. But it isn’t a normal DUI.”

Hollywood Police Officer Joel Francisco had pulled Torrensvillas over at a green light, and he ended up rear-ending her car and would have faced a citation for following her too close. Hollywood Officer Dewey Pressley then arrived on scene, wrote the report and arrested Torrensvillas. This is the conversation outside of his police cruiser that night:

“We’re going to bend this a little bit, OK, because she is so drunk, so it is what it is,” said Pressley.
“Hey, you are the expert,” said another officer.

“Well, I don’t want to make things up ever because it’s wrong, but if I need to bend it a little bit to protect a cop, I’m gonna,” said Pressley. “We’ll do a little Walt Disney to protect the cop because it wouldn’t matter because she is drunk anyway.”

Francisco hit the car, which Torrensvillas had abandoned to rescue her cat. “She never says, ‘I slammed on my brakes,’” Donnelly told the jury, saying Pressley had tried to coerce her to take the blame for the accident. “Officer Pressley says, ‘So you slammed on your brakes, you abruptly slammed on your brakes,’ and then later on, in the 12-minute interview later on in the tape … he’s telling the other officers there, ‘Yeah, I got her to say … I told her to say, ‘You abruptly slammed on the brakes,’ blah, blah, blah.”

The defense insists officer Pressley was just talking big but never falsified any paperwork. “The only person that’s been in this courtroom that is guilty of falsifying records that have been filed in the court is James Leonard who swore, under oath, that Joel Francisco and Dewey Pressley should be arrested,” Defense Attorney Rhea Grossman said.

Technically, the 10 charges add up to 30 years in state prison. However, considering Pressley has no priors and a clean record, if convicted, he could face a much lower sentence.

The charge is a misdemeanor, The Atlanta Journal-Constitution reported. Police in Broward County say Anderson walked away Sunday after hitting two trees with his Cadillac Escalade.

Anderson has not been charged with drunken driving, although police said he had clearly been drinking when he was tracked down at his home in Pembroke Pines. He allegedly admitted being at a bar before the crash.

He said a tire blew out on his car, causing him to lose control. Investigators said all four tires had blown out and the rims were bent.

After playing two seasons at Georgia Tech, Anderson joined the New Jersey Nets, where he played for five years. He went on to play for eight more teams in his remaining decade as a pro.

There are several ways in which police officers work to keep drunk drivers off the roads.  One of the most common ways is through DUI checkpoints.  They will typically set these up late at night or early in the morning because this is usually when impaired drivers are on the roads.  The police officers will often stop every other car or they will stop cars in patterns in order to see if the drivers are impaired.  If they are impaired, they will have the driver get out of the car and start a process of determining whether or not the driver has had too much to drink.

Usually, determining whether a driver is impaired includes several steps.  The first step might be to search the vehicle in order to find any opened containers or bottles of alcohol.  The driver has the right to refuse the search if they choose.  Another method is to have the driver perform a sobriety test, such as walking in a straight line, saying the alphabet backwards or following a finger with their eyes.  Of course, the way the driver performs these tests will give some insight as to how much they’ve drank and whether they are sober enough to be driving.

After this, the police officer may have the driver do a breath test to check blood alcohol levels.  Should the officer determine that the driver has been drinking too much to be driving, the driver will most likely be arrested and held in jail.  Usually, the driver is charged with a DUI.  In every case where a person is charged with a DUI, there is the chance to lose their license, pay an enormous fine, spend time in jail and more.  This is why it’s so important to hire an attorney to defend you in a DUI case, especially if you didn’t think you were impaired.  This is because some tests may show up with inaccurate blood alcohol levels.  While the margin for error isn’t that great, it’s enough to move a legal driver to the illegal blood alcohol level area.

If you have more than one drink and in some cases, even one drink, you should refrain from operating your vehicle.  Have someone call a cab for you or have a non-drinking friend drive you home.  Taking simple precautions like these will ensure that you are never in a position to be arrested and charged with a DUI.  With a criminal conviction like that, you could have a hard time getting a job, getting credit and much more.  Knowing what happens to drunk drivers is one important way to avoid the entire situation.

There are a few things you should know about how the police catch drivers in this way.  While they simply walk up and talk to you at first, the police are using their senses to tell whether you’ve been drinking or are under the influence.  If you have had too much to drink, the police will likely see that you are impaired in some way.  If alcohol causes you to slur your words or speak sluggishly, they will hear this.  They will be able to smell certain types of alcohol on your breath or in your car.  Each one of these clues will be used to assess whether or not you are an impaired driver.

If it has been determined by the police officer that you are impaired, it is likely that he will have you get out of the vehicle.  The first thing you should know is that most officers will ask you to search your car.  If they ask you to search your car, this means that they have absolutely no legal right to search your car in the first place, so you can say no.  If they had a warrant to search your property, they would not ask you to do so, they would just do it.

So, when you get out of your car, lock it and keep the keys in your hand.  Another thing a police officer will do if you’ve been pulled over at a DUI checkpoint is ask you to perform some sobriety tests.  This might include walking in a straight line, saying your alphabet backwards and even touching your nose with your finger.  You can also refuse these tests if you choose.  If you do refuse them, there is one less reason for the police officer to arrest you in the first place.  However, after this he will typically ask you to take a breathalyzer or blood alcohol level test.  While you can refuse these, often times the consequences are worse than the punishment for driving under the influence.

Usually, checkpoints are set up late at night or early in the morning when most of the drunk drivers are out and about.  They will be set up more frequently or in more quantity when there is some special event or holiday like New Year’s Eve or July 4th.  This is because they realize that more people will be out and in a partying mood, so they will probably be more likely to drive impaired.  Knowing when to avoid driving is very important and if you’ve had too much to drink, stay away from the wheel.

Having an attorney that can prepare a proper defense for your DUI case is quite important.  Each year, the penalties and consequences for a DUI are getting more severe.  In fact, along with the jail time, fees and suspended license, you could also be punished with higher insurance fees and a criminal conviction.  Should you be convicted of a crime, you will face difficulties trying to get jobs in the future, trying to get loans or other things.  So, what exactly can a DUI attorney do for you?

An attorney would be able to question the results of your blood alcohol level test.  Although many of them are accurate, there are times when they are wrong.  For instance, the breathalyzer can be wrong enough to catapult your blood level test from acceptable to over the legal limit.  Being able to challenge this and be sure that the results were absolutely positive is something that you can do with an attorney that specializes in DUI cases.  Another thing an attorney can do for you is work to reduce the consequences that you will face.  For instance, rather than facing jail time, your punishment could be lowered to probation or a fine.  An attorney is valuable at this time because they understand the ins and outs of the law and what can be challenged and what cannot be.  They also understand which blood alcohol level tests commonly show up with a wrong reading as well as how to challenge it. 

Without an attorney who understands the laws and DUI cases, you could end up getting the maximum sentencing for a DUI as well as paying huge fees and losing the privilege of your driver’s license.  Start by narrowing down your choice of attorneys based on their experience and then begin calling attorneys for interviews.  This will help you get a sense of whether or not you will be comfortable with a particular one.  Most citizens don’t know the laws and how they are applied to DUI cases.  This is why an attorney is needed in every DUI case.
